What to expect when charged with a criminal or DWI offense?
When you are first charged with any crime in New York State, you are either issued an appearance summons to appear in court at a later date for arraignment or you are held to appear before a judge, usually the next day, for an arraignment. An arraignment is a process before a judge where an initial plea of not guilty is entered and the Court then may decide a number of preliminary issues, the most important of which is the defendants custody status. It is IMPERATIVE to have a criminal lawyer with you or your loved one at this point in time. Once the custody status is determined, the matter is usually scheduled for a conference where the attorneys and the judge will discuss important issues such as disclosure of the prosecutions evidence and potential motion and hearing schedules.
